NO PURCHASE OR PAYMENT IS NECESSARY TO BE SELECTED AS THE WINNER OF THE GIVEAWAY. A PURCHASE OR PAYMENT DOES NOT INCREASE THE CHANCES OF WINNING.

 

ELIGIBILITY:

 

The “RJ” Honda CR250R (“Giveaway”) is open to permanent legal residents of the 48 contiguous United States, the District of Columbia, and Canada (excluding Quebec, Newfoundland and Labrador) who are 18 years of age or older at time of entry and have a valid driver’s license. The Giveaway is subject to all applicable federal, state and local laws and regulations and is void where prohibited by law. By participating in the Giveaway, entrants agree to be bound by these Official Rules. It is the responsibility of the entrant to ensure eligibility requirements are met. Winning the prize is contingent upon fulfilling all requirements outlined in these Official Rules. Family members and persons living in the household of any member of M Berger LLC (the “Sponsor”) are ineligible.

 

PROMOTION PERIOD:

 

The “RJ” Honda CR250R Giveaway begins at 12:00 am Eastern Standard Time (“EST”) on July 12th, 2023 and ends at 11:59 pm Eastern Standard Time (“EST”) on December 21st, 2023.

 

HOW TO ENTER:

 

By purchasing entries on the Sponsor’s website at www.mxbuilds.com during the promotion period. Entries will only be available for purchase during the promotion period. Entrants may purchase multiple entries. Entry purchases are non refundable. Entries will not increase in price during the promotion period, but there may be limited time discount codes shared throughout the promotion period on different social media platforms.

To enter without a purchase via a mail-in, hand write the following on the front of a standard 4x6 postcard with no outer envelope: your full name, address, city, state, zip/postal code, e-mail address, telephone number and date of birth. Mail the postcard to: MX Builds Giveaway, P.O. Box 112, Mogadore, OH 44260. The mailing address must be handwritten. All mail-in entries must include all requested information stated above to be considered an entry. Limit one (1) mail-in entry per person. You will receive 1 (1) entry into the Giveaway for your mail-in entry. Requests for confirmation of receipt of mail-in entries will not be acknowledged. Sponsor is not responsible for late, lost, damaged, stolen, incomplete, illegible, postage due, or misdirected entries. Proof of mailing does not constitute proof of delivery. If you use fraudulent methods or multiple identities, your submission may be removed from eligibility at the sole discretion of M Berger LLC.

 

USE OF INFORMATION:

 

All information must be complete to be eligible. Personal information collected from entrant is used

only for the purpose of the Giveaway and will not be re-used, sold or shared in any manner. By entering this Giveaway you agree that any member of M Berger LLC will have the right, as permitted by law, without any further notice, review or consent to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the world, your entry, including, without limitation, the winner’s name, picture, voice, or statements about the Giveaway, and biographical information as news, publicity or information and for trade, advertising, and promotional purposes without any further compensation.

 

SELECTION OF WINNER:

 

The winner of the Giveaway will be selected from eligible entries randomly by a member of M Berger LLC. The winner will be notified via the contact information provided at checkout when purchasing entries or via the information written on a mail-in entry. The winner will be notified within two (2) days following the winner selection. M Berger LLC holds no liability for a winner’s failure to receive notices as a result of incorrect or non-functioning contact information. If the selected winner does not respond within three (3) days of notification or is deemed ineligible, the prize will be forfeited and an alternate winner will be selected randomly. The winner of the prize offered in this Giveaway must comply with any and all federal and state laws and regulations associated with accepting the prize. A minimum number of 400 entrants must be reached for the Giveaway to commence. Violation of these rules by a selected winner will result in the selected winner’s immediate disqualification from the Giveaway at the sole discretion of M Berger LLC.

 

PRIZE DETAILS:

 

The selected winner will receive a 2003 Honda CR250R dirt bike. The CR250R will have 5 hours or less on the hour meter to allow for a break in period and machine tuning. The prize winner is responsible for registration and any other expenses not listed related to acceptance and use of prize and must provide a valid driver’s license. The prize is awarded “AS IS” and without warranty of any kind. The prize winner is responsible for the payment of taxes on their prize and for any other costs and expenses associated with the acceptance and use of the prize. The winner will receive the prize by freight methods selected by M Berger LLC or will be delivered directly by a member of M Berger LLC depending on the location of the winner. The prize will also be available for pick up by the winner.

 

LIMITATION OF LIABILITY:

 

By entering, you agree to release and hold harmless M Berger LLC and its members from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by negligence or not, from (1) such entrant’s participation in the Giveaway and/or his/her acceptance, possession, use, or misuse of any prize, (2) electronic or human error which may occur in the administration of the Promotion or the processing of entries.

 

DISPUTES:

 

By entering the sweepstakes, entrant agrees that to the extent permitted by applicable law: (1) any and all disputes, claims, and causes of action arising out of or connected with the sweepstakes, or any prize awarded, will be resolved individually, without resort to any form of class action, exclusively before a court located in Ohio having jurisdiction; (2) any and all claims, judgments, and awards will be limited to actual third-party, out-of-pocket costs incurred (if any) not to exceed five dollars (US $5.00), but in no event will attorneys’ fees be awarded or recoverable; (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby knowingly and expressly waives all rights to seek, punitive, incidental, consequential, or special damages, lost profits, and/or any other damages, other than actual out-of-pocket expenses not to exceed five dollars (US $5.00), and/or any rights to have damages multiplied or otherwise increased; and (4) entrants’ remedies are limited to a claim for money damages (if any) and entrant irrevocably waives any right to seek injunctive or equitable relief. Some jurisdictions do not allow the limitations or exclusion of liability, so the above may not apply to you. Each participant agrees (1) to abide by the terms of these official rules and the decisions of the sweepstakes entities which are final and binding on all matters relating to this sweepstakes, and (2) to release, discharge, indemnify and hold harmless the released parties from any and all claims or liability in connection with participation in this sweepstakes or acceptance or use of any prize including, without limitation, any activity related thereto.

 

WINNERS LIST:

 

The winner will be posted on www.mxbuilds.com within 30 days after the winner has been confirmed, verified and received the prize.
